Il s\u2019applique \u00e0 tous les stagiaires, et ce pour la dur\u00e9e de la formation suivie.<\/p>\n<p><strong>Article 2 : Discipline\u00a0:<\/strong><\/p>\n<p>Il est formellement interdit aux stagiaires :<\/p>\n<p>&#8211; D\u2019introduire des boissons alcoolis\u00e9es dans les locaux de l\u2019organisme\u00a0;<\/p>\n<p>&#8211; De se pr\u00e9senter aux formations en \u00e9tat d\u2019\u00e9bri\u00e9t\u00e9\u00a0;<\/p>\n<p>&#8211; D\u2019emporter ou modifier les supports de formation\u00a0;<\/p>\n<p>&#8211; De modifier les r\u00e9glages des param\u00e8tres de l\u2019ordinateur\u00a0;<\/p>\n<p>&#8211; De manger dans les salles de cours\u00a0;<\/p>\n<p>&#8211; D\u2019utiliser leurs t\u00e9l\u00e9phones portables durant les sessions\u00a0;<\/p>\n<p><strong>Article 3 : Sanctions<\/strong><\/p>\n<p><strong>\u00a0<\/strong>Tout agissement consid\u00e9r\u00e9 comme fautif par la direction de l\u2019organisme de formation pourra, en fonction de sa nature et de sa gravit\u00e9, faire l\u2019objet de l\u2019une ou l\u2019autre des sanctions ci-apr\u00e8s par ordre croissant d\u2019importance :<\/p>\n<ul>\n<li>Avertissement \u00e9crit par le Directeur de l\u2019organisme de formation ;<\/li>\n<li>Bl\u00e2me<\/li>\n<li>Exclusion d\u00e9finitive de la formation<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><strong>Article 4\u00a0: Entretien pr\u00e9alable \u00e0 une sanction et proc\u00e9dure.<\/strong><\/p>\n<p>Aucune sanction ne peut \u00eatre inflig\u00e9e au stagiaire sans que celui-ci ne soit inform\u00e9 dans le m\u00eame temps et par \u00e9crit des griefs retenus contre lui. Lorsque l\u2019organisme de formation envisage une prise de sanction, il convoque le stagiaire par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception ou remise \u00e0 l\u2019int\u00e9ress\u00e9 contre d\u00e9charge en lui indiquant l\u2019objet de la convocation, la date, l\u2019heure et le lieu de l\u2019entretien, sauf si la sanction envisag\u00e9e n\u2019a pas d\u2019incidence sur la pr\u00e9sence du stagiaire pour la suite de la formation.<\/p>\n<p><strong>\u00a0<\/strong>Au cours de l\u2019entretien, le stagiaire a la possibilit\u00e9 de se faire assister par une personne de son choix, stagiaire ou salari\u00e9 de l\u2019organisme de formation. La convocation mentionn\u00e9e \u00e0 l\u2019article pr\u00e9c\u00e9dent fait \u00e9tat de cette facult\u00e9. Lors de l\u2019entretien, le motif de la sanction envisag\u00e9e est indiqu\u00e9 au stagiaire\u00a0: celui-ci a alors la possibilit\u00e9 de donner toute explication ou justification des faits qui lui sont reproch\u00e9s.<\/p>\n<p><strong>\u00a0<\/strong>Lorsqu\u2019une mesure conservatoire d\u2019exclusion temporaire \u00e0 effet imm\u00e9diat est consid\u00e9r\u00e9e comme indispensable par l\u2019organisme de formation, aucune sanction d\u00e9finitive relative \u00e0 l\u2019agissement fautif \u00e0 l\u2019origine de cette exclusion ne peut \u00eatre prise sans que le stagiaire n\u2019ait \u00e9t\u00e9 au pr\u00e9alable inform\u00e9 des griefs retenus contre lui et, \u00e9ventuellement, qu\u2019il ait \u00e9t\u00e9 convoqu\u00e9 \u00e0 un entretien et ait eu la possibilit\u00e9 de s\u2019expliquer devant un Commission de discipline.<\/p>\n<p>La sanction ne peut intervenir moins d\u2019un jour franc ni plus de 15 jours apr\u00e8s l\u2019entretien o\u00f9, le cas \u00e9ch\u00e9ant, apr\u00e8s avis de la Commission de discipline.<\/p>\n<p>Elle fait l\u2019objet d\u2019une notification \u00e9crite et motiv\u00e9e au stagiaire sous forme lettre recommand\u00e9e, ou d\u2019une lettre remise contre d\u00e9charge. L\u2019organisme de formation informe concomitamment l\u2019employeur, et \u00e9ventuellement l\u2019organisme paritaire prenant \u00e0 sa charge les frais de formation, de la sanction prise.<\/p>\n<p><strong>\u00a0<\/strong><strong>Article 5 : Repr\u00e9sentation des stagiaires<\/strong><\/p>\n<p><strong>\u00a0<\/strong>Lorsqu\u2019un stage a une dur\u00e9e sup\u00e9rieure \u00e0 500 heures, il est proc\u00e9d\u00e9 \u00e0 l\u2019\u00e9lection d\u2019un d\u00e9l\u00e9gu\u00e9 titulaire et d\u2019un d\u00e9l\u00e9gu\u00e9 suppl\u00e9ant en scrutin uninominal \u00e0 deux tours. Tous les stagiaires sont \u00e9lecteurs et \u00e9ligibles, sauf les d\u00e9tenus admis \u00e0 participer \u00e0 une action de formation professionnelle.<\/p>\n<p><strong>\u00a0<\/strong>L\u2019organisme de formation organise le scrutin qui a lieu pendant les heures de formation, au plus t\u00f4t 20 heures, au plus tard 40 heures apr\u00e8s le d\u00e9but du stage. En cas d\u2019impossibilit\u00e9 de d\u00e9signer les repr\u00e9sentants des stagiaires, l\u2019organisme de formation dresse un PV de carence qu\u2019il transmet au pr\u00e9fet de r\u00e9gion territorialement comp\u00e9tent.<\/p>\n<p>Les d\u00e9l\u00e9gu\u00e9s sont \u00e9lus pour la dur\u00e9e de la formation. Leurs fonctions prennent fin lorsqu\u2019ils cessent, pour quelque cause que ce soit de participer \u00e0 la formation.<\/p>\n<p>Si le d\u00e9l\u00e9gu\u00e9 titulaire et le d\u00e9l\u00e9gu\u00e9 suppl\u00e9ant ont cess\u00e9 leurs fonctions avant la fin de la session de formation, il est proc\u00e9d\u00e9 \u00e0 une nouvelle \u00e9lection dans les conditions pr\u00e9vues aux articles R.6352-9 \u00e0 R.6352-12.<\/p>\n<p><strong>\u00a0<\/strong>Les repr\u00e9sentants des stagiaires font toute suggestion pour am\u00e9liorer le d\u00e9roulement des stages et les conditions de vie des stagiaires dans l\u2019organisme de formation. Ils pr\u00e9sentent toutes les r\u00e9clamations individuelles ou collectives relatives \u00e0 ces mati\u00e8res, aux conditions d\u2019hygi\u00e8ne et de s\u00e9curit\u00e9 et \u00e0 l\u2019application du r\u00e8glement int\u00e9rieur.<\/p>\n<p><strong>\u00a0<\/strong><strong>Article 6\u00a0: Hygi\u00e8ne et s\u00e9curit\u00e9\u00a0:<\/strong><\/p>\n<p>La pr\u00e9vention des risques d\u2019accidents et de maladies est imp\u00e9rative et exige de chacun le respect total de toutes les prescriptions applicables en mati\u00e8re d\u2019hygi\u00e8ne et de s\u00e9curit\u00e9.
